1. Overview
EverHomeCall ("we," "us," or "our") is a subscription service that delivers automated, AI-powered check-in voice calls to seniors on behalf of their family members and caregivers ("you"). By creating an account or using our service, you agree to these Terms of Service.
2. Not a Medical or Emergency Service
EverHomeCall is not a medical service, emergency response service, or substitute for professional care. Our calls are wellness check-ins only. If your loved one is in danger or requires immediate assistance, call 911. We are not responsible for outcomes related to missed calls, failed deliveries, or any health event.
3. Consent to Automated Calls
By providing a phone number and activating service, you represent that you have obtained consent from the call recipient to receive automated voice calls from EverHomeCall. You are responsible for ensuring the recipient is willing and able to receive these calls. We comply with applicable telemarketing and robocall regulations, including the TCPA.
4. Subscriptions and Billing
EverHomeCall is offered on a recurring subscription basis. By subscribing, you authorize us to charge your payment method on the billing cycle you selected. Payments are processed securely by Stripe. You may cancel at any time from your account; cancellation takes effect at the end of your current billing period. We do not offer refunds for partial periods.
5. Account Responsibilities
You are responsible for maintaining the accuracy of account information, including the phone number and emergency contacts you provide. You must keep your login credentials secure. You may not share accounts or use the service on behalf of someone else without their knowledge and consent.
6. Service Availability
We strive to deliver calls reliably, but we do not guarantee uninterrupted service. Calls may fail due to carrier issues, number changes, network outages, or other factors outside our control. We will make reasonable efforts to notify you of service disruptions.
7. Acceptable Use
You may not use EverHomeCall for any unlawful purpose, to harass or deceive call recipients, or in any way that violates applicable laws. We reserve the right to suspend or terminate accounts that violate these terms.
8. Limitation of Liability
To the fullest extent permitted by law, EverHomeCall and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to missed check-ins, technical failures, or reliance on call outcomes as a substitute for direct care.
9. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of material changes by email or by posting a notice on the site. Continued use of the service after changes take effect constitutes your acceptance.
